WASHINGTON – President-elect Obama's advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice. During his campaign, Obama described Guantanamo as a "sad chapter in American history" and has said generally that the U.S. legal system is equipped to handle the detainees. But he has offered few details on what he planned to do once the facility is closed. Under plans being put together in Obama's camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts. A third group of detainees — the ones whose cases are most entangled in highly classified information — might have to go before a new court designed especially to handle sensitive national security cases, according to advisers and Democrats involved in the talks. Advisers participating directly in the planning spoke on condition of anonymity because the plans aren't final. The move would be a sharp deviation from the Bush administration, which established military tribunals to prosecute detainees at the Navy base in Cuba and strongly opposes bringing prisoners to the United States. Obama's Republican challenger, John McCain, had also pledged to close Guantanamo. But McCain opposed criminal trials, saying the Bush administration's tribunals should continue on U.S. soil. The plan being developed by Obama's team has been championed by legal scholars from both political parties. But it is almost certain to face opposition from Republicans who oppose bringing terrorism suspects to the U.S. and from Democrats who oppose creating a new court system with fewer rights for detainees. Naomi Klein The Guardian, Friday October 31 2008 In the final days of the election many Republicans seem to have given up the fight for power. But don't be fooled: that doesn't mean they are relaxing. If you want to see real Republican elbow grease, check out the energy going into chucking great chunks of the $700bn bail-out out the door. At a recent Senate banking committee hearing, the Republican Bob Corker was fixated on this task, and with a clear deadline in mind: inauguration. "How much of it do you think may be actually spent by January 20 or so?" Corker asked Neel Kashkari, the 35-year-old former banker in charge of the bail-out. When European colonialists realised that they had no choice but to hand over power to the indigenous citizens, they would often turn their attention to stripping the local treasury of its gold and grabbing valuable livestock. If they were really nasty, like the Portuguese in Mozambique in the mid-1970s, they poured concrete down the elevator shafts. Nothing so barbaric for the Bush gang. Rather than open plunder, it prefers bureaucratic instruments, such as "distressed asset" auctions and the "equity purchase program". But make no mistake: the goal is the same as it was for the defeated Portuguese - a final, frantic looting of the public wealth before they hand over the keys to the safe. How else to make sense of the bizarre decisions that have governed the allocation of the bail-out money? When the Bush administration announced it would be injecting $250bn into US banks in exchange for equity, the plan was widely referred to as "partial nationalisation" - a radical measure required to get banks lending again. Henry Paulson, the treasury secretary, had seen the light, we were told, and was following the lead of Gordon Brown. In fact, there has been no nationalisation, partial or otherwise. American taxpayers have gained no meaningful control over the banks, which is why the banks are free to spend the new money as they wish. At Morgan Stanley, it looks as if much of the windfall will cover this year's bonuses. Citigroup has been hinting it will use its $25bn buying other banks, while John Thain, the chief executive of Merrill Lynch, told analysts: "At least for the next quarter, it's just going to be a cushion." The US government, meanwhile, is reduced to pleading with the banks that they at least spend a portion of the taxpayer windfall for loans - officially, the reason for the entire programme. What, then, is the real purpose of the bail-out? My fear is this rush of dealmaking is something much more ambitious than a one-off gift to big business: that the Bush version of "partial nationalisation" is rigged to turn the US treasury into a bottomless cash machine for the banks for years to come. Remember, the main concern among the big market players, particularly banks, is not the lack of credit but their battered share prices. Investors have lost confidence in the honesty of the big financial players, and with good reason. This is where the treasury's equity pays off big time. By purchasing stakes in these financial institutions, the treasury is sending a signal to the market that they are a safe bet. Why safe? Not because their level of risk has been accurately assessed at last. Not because they have renounced the kind of exotic instruments and outrageous leverage rates that created the crisis. But because the market will now be banking on the fact that the US government won't let these particular companies fail. If they get themselves into trouble, investors will now assume that the government will keep finding more cash to bail them out, since allowing them to go down would mean losing the initial equity investments, many of them in the billions. (Just look at the insurance giant AIG, which has already gone back to taxpayers for a top-up, and seems likely to ask for a third.) This tethering of the public interest to private companies is the real purpose of the bail-out plan: Paulson is handing all the companies admitted to the programme - a number potentially in the thousands - an implicit treasury department guarantee. To skittish investors looking for safe places to park their money, these equity deals will be even more comforting than a triple-A from Moody's rating agency. Insurance like that is priceless. But for the banks, the best part is that the government is paying them to accept its seal of approval. For taxpayers, on the other hand, this entire plan is extremely risky, and may well cost significantly more than Paulson's original idea of buying up $700bn in toxic debts. Now taxpayers aren't just on the hook for the debts but, arguably, for the fate of every corporation that sells them equity. Interestingly, mortgage fund giants Fannie Mae and Freddie Mac both enjoyed this kind of unspoken guarantee before they were nationalised at the start of this crisis. For decades the market understood that, since these private players were enmeshed with the government, Uncle Sam could be counted on to always save the day. It was, as many have pointed out, the worst of all worlds. Not only were profits privatised while risks were socialised, but the implicit government backing created powerful incentives for reckless business practices. With the new equity purchase programme Paulson has taken the discredited Fannie and Freddie model and applied it to a huge swath of the private banking industry. Again, there is no reason to shy away from risky bets, especially since the treasury has made no such demands of the banks (apparently it doesn't want to "micromanage".) To further boost market confidence, the federal government has also unveiled unlimited public guarantees for many bank deposit accounts. Oh, and as if this were not enough, the treasury has been encouraging the banks to merge, ensuring that the only institutions left will be "too big to fail", thereby guaranteed a bail-out. In three ways, the market is being told loud and clear that Washington will not allow the financial institutions to bear the consequences of their behaviour. This may be Bush's most creative innovation: no-risk capitalism. There is a glimmer of hope. In answer to Senator Corker's question, the treasury is indeed having trouble dispersing the bail-out funds. So far it has requested about $350bn of the $700bn, but most of this hasn't yet made it out the door. Meanwhile, every day it becomes clearer that the bail-out was sold to the public on false pretences. Clearly, it was never really about getting loans flowing. It was always about doing what it is doing: turning the state into a giant insurance agency for Wall Street, a safety net for the people who need it least, subsidised by the people who will most need state protections in the economic storms ahead. This duplicity is a political opportunity. Whoever wins on November 4 will have enormous moral authority. It should be used to call for a freeze on the dispersal of bail-out funds, not after the inauguration but right away. All deals should be renegotiated, this time with the public getting the guarantees. It is risky, of course, to interrupt the bail-out process. Nothing could be riskier, however, than allowing the Bush gang their parting gift to big business - the gift that will keep on taking. The Guardian

Grad student Juan Escobar and his colleagues managed to make an X-ray of a thumb using the technique. Apparently, Russian scientists reported fifty years ago that the act of peeling sticking tape can emit X-rays, but the new research confirms the early results.

On October 18, 2008, Joe reportedly made a phone call to the emergency number 911 in Northern Virginia, complaining about being stuck in traffic, which he ended with an obscenity. McCain was allegedly stuck on Interstate 495 at the Wilson Bridge. He called 911 and when asked to describe the emergency replied: "Well, it's not an emergency, but do you know why on one side at the damn drawbridge of 95 traffic is stopped for 15 minutes and yet traffic's coming the other way?" The operator then inquired if McCain was using the 911 service to complain about traffic. McCain then issued the expletive "fuck you" and hung up; he later said he believed the call was muted before swearing. "I did not mean to swear at the officers themselves... [if I were in their situation] it would have really frosted me too and I absolutely understand their reaction." Alexandria Police 911 personell called Mr. McCain back to advise him that abuse of the 911 Emergency System was a criminal offense, but had to leave a voice message on his phone. Shortly thereafter, Mr. McCain again called the Alexandria Sheriff's office and stated that he had been contacted by the 911 Emergency Services and apprised his actons were a violation of the Law. Mr. McCain said "Somebody gave me this riot act about the violation of police" in response to the call he recieved. Additionally, it was reported that Mr. McCain asked them "Do you know who I am" and that he had been on his way to a very important political event that he was involved in for a member of his family. On October 24, 2008, Joe McCain withdrew from campaign activities and apologized for calling both 911 and the Alexandria Police

The Statement: Speaking during a campaign stop Monday, Oct. 20 in Belton, Missouri, Republican presidential nominee Sen. John McCain criticized Democratic opponent Sen. Barack Obama's proposals on taxes. "The Obama tax increase would come at the worst possible time for America, and especially for small businesses like the one Joe dreams of owning," McCain said. "The small businesses Senator Obama would tax provide 16 million jobs in America." Get the facts! The Facts: McCain's criticism appears primarily aimed at Obama's personal income tax proposals — which he says would give tax cuts or leave taxes the same for individuals who make less than $200,000 or families that earn less than $250,000 — but increase them on people making more. Roughly 85 percent of small businesses are taxed at the owner's personal income tax rate, according to an editorial in the Wall Street Journal. Most of those businesses earn less than $250,000 a year. The McCain campaign uses figures from a National Federation of Independent Business survey to back up its claim. The survey says 12 percent of business owners who employ between one and nine people earn more than $200,000 a year — as do 27 percent of those who employ 10-19 people and 50 percent of those who employ between 20 and 250 workers. Obama says $200,000 is the lowest income level at which an individual would see a tax increase under his plan. But in assuming all of those business owners would see an increase, the McCain campaign appears to suppose that all of the business owners making between $200,000 and $250,000 would file their taxes individually, not jointly with a spouse or other family member. And roughly 15 percent of small businesses aren't taxed based on the owner's personal income rate, as the Journal notes. Based on those facts, it's impossible to know exactly how many of those business owners would see a tax hike — but it surely would not be 100 percent. The McCain campaign uses census figures to estimate how many people work for the businesses it says would be impacted — an effort McCain spokesman Brian Rogers acknowledges is "admittedly a rough estimate." The NFIB says the number of jobs small businesses create is "impossible to calculate," in part because some people only work at small businesses part-time while holding down full time jobs with a bigger employer.

The Verdict: False. McCain uses an overly broad interpretation of the NFIB survey's figures — applying Obama's tax plan to those figures in a way that is highly unlikely to match reality.

Sunday morning, NBC's Tom Brokaw talked with MSNBC political analyst Chuck Todd about how the polls are shaping up just several weeks prior to the election. Todd told Brokaw that at this point, McCain appears to be "conceding the popular vote" in order to pursue victory through the Electoral College, similar to how outgoing President George W. Bush came to power. Todd, making the argument that older voters could be the crucial demographic in the election's endgame, claimed there's been some evidence that they are shifting toward Obama. "That's how this thing becomes, from a close Electoral College battle to a landslide," he said. "And by the way, one more point about our map, as we're seeing this shift. It's almost as if the McCain campaign is conceding the popular vote. We're seeing a lot of tightening in some places that, while Obama won't carry them, he's not gonna lose by large margins. ANCHORAGE, Alaska – The beluga whales of Alaska's Cook Inlet are endangered and require additional protection to survive, the government declared Friday, contradicting Gov. Sarah Palin who has questioned whether the distinctive white whales are actually declining. It was the Republican vice presidential candidate's second environmental slap from Washington this year. She has asked federal courts to overturn an Interior Department decision declaring polar bears threatened under the Endangered Species Act. The government on Friday put a portion of the whales on the endangered list, rejecting Palin's argument that it lacked scientific evidence to do so. The National Oceanic and Atmospheric Administration said that a decade-long recovery program had failed to ensure the whales' survival. "In spite of protections already in place, Cook Inlet beluga whales are not recovering," said James Balsiger, NOAA acting assistant administrator. The decision means that before federal agencies can issue a variety of commercial permits, they must first consult with the National Marine Fisheries Service to determine if there are potential harmful effects on the whales. That has the potential to affect major Alaska projects including an expansion of the Port of Anchorage, additional offshore oil and gas drilling, a proposed $600 million bridge connecting Anchorage to Palin's hometown of Wasilla and a massive coal mine 45 miles south of Anchorage. The state does have serious concerns about the low population of beluga whales in Cook Inlet and has had those concerns for many years, Palin said in a statement. "However, we believe that this endangered listing is premature," she said. Palin in April successfully lobbied for a six-month delay in a listing decision until a count of the whales this summer could be included in deliberations. That count showed no increase over 2007 numbers — 375 whales, compared with a high of 653 in 1995.

At issue is a requirement that executive branch offices provide data on how much material they classify and declassify.
